The Urgent Handling of the Work of Foreign Experts during Public Health Emergencies.

Article 1 The procedures are formulated in accordance with the Regulation on the Urgent Handling of Public Health Emergencies for the purpose of eliminating the hazards of public health emergencies, safeguarding the health, life safety and vital interests of foreign experts in China and maintaining the normal working order for introducing foreign talents.
Article 2 The term “public health emergencies” as mentioned in the procedures (hereafter “emergencies”) refers to the sudden outburst of a serious contagious disease, colonial disease of unknown causes, important alimentary or occupational toxicosis that have caused or may cause severe effect on the health of the general public and other incidents that severely affect the health of the public.
Article 3 The term “foreign experts in China” as mentioned in the procedures (hereafter “foreign experts”) refers to overseas experts and experts from Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan, China working for the economic and technological management field, the educational, scientific, cultural and health care industries, foreign-funded enterprises, introduction projects, key construction projects and some other projects in China.
Article 4 When an emergency outbreaks, the State Administration of Foreign Experts Affairs (SAFEA) shall set up a national leading group for the urgent handling of the emergencies and the work of foreign experts, which shall be composed of the administrative department in charge of the work of foreign experts under SAFEA and relevant departments, with the head of SAFEA as the group leader to be responsible for the overall leadership and command of the urgent handling of the work of foreign experts in the whole country.
Article 5 When any emergency breaks out, the special department for managing foreign expert affairs of the provinces, autonomous regions and municipalities shall set up local leading groups for the urgent handling of the emergencies and the work of foreign experts, with the main leaders of those special department for managing foreign experts affairs as the group leaders to be responsible for the leadership the command of the urgent handling of the work of foreign experts within their respective jurisdiction.
Article 6 In the urgent handling of emergencies, the guideline of giving priority to prophylaxis and being always on alert shall be followed, and the principles of unified leadership, level-by-level responsibility, timely response, resolute decision-making, reliance on science and strengthening cooperation shall be adhered to.
Article 7 The administrative department in charge of the work of foreign experts under SAFEAshall formulate national plans for the urgent handling of the work of foreign experts according to the principle of classified guidance and rapid response, and submit them to SAFEA for ratification. The special department for managing foreign expert affairs of the provinces, autonomous regions and municipalities shall formulate plans for the urgent handling of the work of foreign experts within their respective jurisdiction on the basis of the national plans and by taking the practical situations of the local places into consideration.
Article 8 The national plans for the urgent handling of the work of foreign experts shall cover the following aspects:

(1) The composition of the leading group for the urgent handling of emergencies and the work of foreign experts as well as the functions or duties of relevant departments.

(2) The collection, analysis, report and notification system about the job information of foreign experts during emergencies.

(3) The grading of the jobs of foreign experts and the urgent handling of their work during emergencies.
Article 9 The plans for the urgent handling of the work of foreign experts shall be revised and supplemented in good time according the changes that arise in the emergencies and the problems that are found in the implementation of the plans.
Article 10 A Reporting System for the Urgent Handling of Emergencies shall be established. The administrative department in charge of the work of foreign experts under SAFEA shall formulate rules for the emergency report of the work of foreign experts, and establish a foreign expert information report system during emergencies. When any emergencies breaks, the special department for managing foreign expert affairs of the provinces, autonomous regions and municipalities shall report the work, lives and health condition of foreign experts within their respective jurisdiction to the administrative department in charge of the work of foreign experts under SAFEA
Article 11 No unit or person shall or incite others to conceal the facts, delay the report or give a false report of foreign experts’ condition during emergencies, or the violators shall be duly punished according to the relevant rules of the Regulation of the Urgent Handling of Public Health Emergencies.
Article 12 A Reporting System about the Emergencies shall be established. Supervisor in charge of the work of foreign experts shall be responsible for informing foreign experts in China and the National Expert Group engaged in dispatching experts of emergencies and the information of those experts in China, or empowering the special department for managing foreign expert affairs of the provinces, autonomous regions and municipalities to do that within their respective jurisdiction when necessary.
Article 13 When an emergency outbreaks, the administrative department in charge of the work of foreign experts under SAFEAshall organized experts to conduct comprehensive assessment on the influences of emergencies upon the work of foreign experts, and table a proposal —— whether to start up the plans for the urgent handling of the work of foreign experts.
Article 14 When starting up the national plans for the urgent handling of the work of foreign experts throughout the country or across provinces, autonomous regions and municipalities, the national administrative department in charge of the work of foreign experts shall submit it to SEFEA for ratification and implementation. When provinces, autonomous regions and municipalities start up the plans for the urgent handling of the work of foreign experts, the special department for managing foreign expert affairs of the provinces, autonomous regions and municipalities shall be responsible for the implementation and reporting it to SEFEA.
Article 15 Leading group for the urgent handling of national emergencies and the work of foreign experts shall supervise and guide the emergency response and handling work, with the cooperation of the local special department for managing foreign expert affairs at different levels. Likewise, leading group for the urgent handling of emergencies and the work of foreign experts in provinces, autonomous regions and municipalities shall supervise and guide the emergency response and handling work within their respective jurisdiction.
Article 16 Before starting up the plans, the special department for managing foreign expert affairs at different levels shall prepare for emergencies and take necessary urgent handling measures according to the local practical situations. Once started, the special department for managing foreign expert affairs where the emergency broke out shall, in accordance with the responsibilities and requirements specified in the plans, obey the unified command of leading group for the urgent handling of emergencies, show up in the right positions immediately and adopt relevant regulatory measures.
Article 17 In case of any other emergencies, the urgent handling of the work of foreign experts shall be implemented by reference to these procedures.
Article 18 SAFEA reserves the right of interpretation for these procedures.
