(Reporters Guo Qian and Wu Qidi)The Executive Meeting of Hubei Provincial Government approved the Implementation Plan of the Construction of Hubei Provincial Government Ruled by Law（2016-2020）which was submitted by the Research Center for Rule of Law Development and Judicial Reform of ZUEL(Hubei Provincial Research Institute for Rule of Law Development).
Entrusted by the Legislative Affairs Office of Hubei Provincial Government , Professor Xu Hanming, President of the Hubei Provincial Research Institute for the Strategies of Rule of Law Development and Director of the Research Center for Rule of Law Development and Judicial Reform of ZUEL, drafted the Implementation Plan of the Construction of the Hubei Provincial Government Ruled by Law（2016-2020）in May 2016 after he had organized research and demonstrations among law experts and scholars in Hubei province. This plan analyzed and pointed out the scientific development path of the construction of Hubei provincial government ruled by law from general demands, major tasks, specific measures, organizational security and implementation mechanism, etc., blueprinting the construction of the rule of law in the next 5 years.
1.As regards the whole frame and system, it is consistent with the “Outline” issued by the CPC Central Committee and the State Council. When it comes to the content, it adheres to concretization and specialization, fully embodying the characteristics of rule of law development in Hubei province. Guided by Marxism, Mao Zedong Thought, Deng Xiaoping Theory, the Thought of “Three Represents” and the Scientific Outlook on Development, the plan is oriented on the important speeches given by General Secretary Xi Jinping, holding high the great banner of socialism with Chinese characteristics. Put forward by the Provincial Party Committee, “to be the first one, to move forward, to upgrade and to lay the foundation are the four development goals pursued by the plan. This plan aims at promoting the modernization of national governance system and governance capability with the concept of innovative development, coordinated development, green development, open development and sharing development. In addition, by deepening law-based administration, speeding up the construction of law-based government, it provides a powerful legal protection for the central region to build a moderately prosperous society and to achieve the goal of building a strategic pivot for a leading role at an early date.
2. In terms of the content, the plan embodies four major characteristics. Firstly, it demonstrates the demand of Hubei Provincial Government that Hubei should lead the construction of rule of law of the nation. Secondly, it promotes the implementation of the “Outline”according to“the five principles”, namely, facilitating the overall process with specific plans, setting up project-based tasks, taking responsibility, formulating a performance assessment based on indicators and setting up appropriate schedule. Thirdly, it strives to reflect the characteristics of Hubei. Finally, it adheres to problem-based approaches.
3. On the matter of arrangement of major tasks, the plan puts forward seven goals.
a. To fully perform government’s functions according to law.
b. To improve the administrative system according to law.
c. To promote scientific, democratic and law-based administrative policy making.
d. Enforce the law strictly and impartially.
e. To strengthen the restriction and supervision of administrative power.
f. To effectively resolve social contradictions and disputes according to law.
g. To comprehensively enhance law-based administration capacity.
In the planning of specific measures, the plan lists 43 scientific and specific development measures based on these seven objectives and the concrete situation and the practical problems of rule of law development in Hubei. The plan generally guides the development direction for one hand, and scientifically promotes the construction of the law-based government for another.
4. In regard of the organizational guarantee and implementation mechanism, the plan provides five strategic measures.
a. To strengthen the leadership of the party towards the construction of the rule of law.
b. To make sure the person in charge take the responsibility.
c. To promote the assessment on the construction of government under the rule of law.
d. To strengthen the construction of legal agencies of the government.
e. To enhance theoretical research and typical demonstration so as to build a good atmosphere of rule of law.
